King v Eric Diaz

The NICOA provided guidance in respect of sentencing for facilitating a breach of immigration law by a non UK national contrary to section 25(1) of the Immigration Act 1971 at paras [28] – [33].

Renewed application for leave to appeal a three year DCS - facilitating the unlawful entry into the UK of a number of Bolivian nationals by means of travel from Dublin, via NI, and onwards to England – whether sentence was manifestly excessive – whether there was disparity with a co-defendant’s sentence – NICOA held overall sentence was appropriate - leave refused – application dismissed
